Terms of Use

These Terms of Use (“Terms”) are entered into between you and Folx Table LLC (“Folx Table,” “we,” “us,” or “our”), the operator of the Outpost service. Outpost operates a web-based platform for in-person social dining events we call “Outposts,” available at outpost.rsvp (the “Website”), together with any related features (collectively, the “Services”).

Please read these Terms carefully before using the Services. By registering for, booking, or attending an Outpost, or by otherwise using the Services, you accept and agree to be bound by these Terms and by our Privacy Policy, available at outpost.rsvp/privacy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Services.

The Services are intended solely for individuals age 18 and older who reside in the United States or its territories. Outposts are held exclusively at U.S. venues, and the Services are not offered outside the United States. By using the Services, you represent that you are at least 18 years old and meet all other eligibility requirements in these Terms. If you do not meet these requirements, you must not use the Services. If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

We may revise these Terms from time to time in our sole discretion. Changes are effective immediately when posted, and your continued use of the Services after a change means you accept it. We encourage you to check this page periodically.

To use certain parts of the Services, you must register and provide accurate, current, and complete information, including your name, email address, and cell phone number — and, for some events, your year of birth and gender — as described in our Privacy Policy. You sign in with a one-time code we text to your cell phone number. You are responsible for maintaining control of that phone number and for all activity under your account. Notify us immediately at hello@outpost.rsvp of any unauthorized use of your account.

We may disable your account at any time, in our sole discretion, including if we believe you have violated these Terms.

When you book an Outpost, you will be asked to enter your card details into a secure payment field provided by Stripe, our payment processor, embedded directly in our booking flow; your card details go to Stripe and are not stored by Outpost. By booking, you authorize us to charge the fees described below to that payment method. Not every Outpost has these penalties enabled; where they apply, they are shown to you at booking.

• All cancellations must be made through your Outpost account (not by direct message or email).
• Cancellations made before 12:00 p.m. (noon) local time the day before your Outpost are free of charge.
• Cancellations made at or after 12:00 p.m. (noon) local time the day before your Outpost result in a $20 late-cancellation fee.
• You have a 15-minute grace period to check in after your Outpost's scheduled start time.
• When you check in, we may ask your device for its location once to confirm you have arrived at the venue; if you decline, you can confirm your arrival manually, as described in our Privacy Policy.
• Checking in after that 15-minute grace period is considered a late check-in and results in a $15 late fee.
• Failing to check in at all is considered a no-show and results in a $25 no-show fee.
• Repeated no-shows, late cancellations, or other violations of this policy may result in suspension or removal from Outpost at our discretion.
• Tickets are non-transferable and non-refundable, except as described above.

Depending on the organization hosting your Outpost and how it has chosen to set up the event, we may ask you preference questions and where you’ll be coming from in order to match you to a table, as described in our Privacy Policy. We do not guarantee any particular seating arrangement, match, or outcome, and matching criteria vary from event to event.

Outposts involve in-person interaction with other attendees whom you may not know. Outpost does not conduct background checks on attendees and cannot guarantee the identity, conduct, compatibility, or safety of any attendee. In-person events carry inherent risks, including the risk of illness, bodily injury, property damage, or theft. By attending an Outpost, you freely and voluntarily assume all such risks arising from your attendance, your consumption of food or drink, and your interactions with other attendees and with any venue, to the fullest extent permitted by applicable law. Nothing in these Terms limits liability that cannot be limited under applicable law, including for gross negligence or willful misconduct.

Alcohol. Some Outposts are hosted at restaurants or venues that serve alcohol under their own liquor license. Ticket prices never include alcohol, and Outpost does not sell, serve, furnish, supply, or pay for alcoholic beverages at any event. Any alcohol is sold solely by the venue, under its own license, at your individual choice and expense. The venue is solely responsible for its alcohol service decisions and for verifying legal drinking age, and may require identification. You must be at least 21 years old to consume alcohol at an Outpost, and you agree not to purchase, provide, or otherwise furnish alcohol to any attendee under 21. If you choose to consume alcohol, you do so at your own risk and are solely responsible for your own consumption, conduct, and transportation. We may remove visibly intoxicated or disruptive attendees from an event, without refund.

After an Outpost, you may choose to share contact details (such as your email address, phone number, Instagram handle, or LinkedIn profile) with the other attendees seated at your table. Sharing is optional and chosen separately for each event. Once you share details with a tablemate, their use of those details is outside Outpost’s control, and Outpost is not responsible for it.

At some Outposts, we invite the attendees seated at a table to take a photo of that table near the end of the evening and add it from their phones. Not every Outpost collects photos; where one does, the invitation appears on your screen during the closing minutes and is announced out loud at your table. Adding a photo is optional, and nobody is required to appear in one.

You may add only photos taken at that Outpost, of your own table and the people seated at it. You must not add a photo of anyone who has asked not to be photographed, of people who are not attending your Outpost, or any content that is unlawful, obscene, harassing, hateful, or that infringes anyone’s rights. We may remove any photo at any time, for any reason.

You keep ownership of the photos you add. By adding a photo, you grant Folx Table LLC a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to host, store, reproduce, adapt (for example, to crop or resize), publicly display, and distribute that photo in connection with operating and promoting the Services — including in Outpost’s own marketing — and to share it with the organization sponsoring your Outpost as described below. You also consent to our use of your name, image, and likeness as they appear in photos added at your table for those same purposes. You represent that you have the right to grant this license for everything the photo contains.

Who can see your table’s photos. For the first 48 hours after your Outpost ends, photos added at your table are visible to the attendees seated at that table, and to Outpost staff, as described in our Privacy Policy. After those 48 hours, they also become visible to the organization sponsoring your Outpost, which may use them for its own purposes, including its own marketing and its reporting about the event. Once an organization has them, its use of those photos is governed by its own policies and is outside Outpost’s control.

Removing a photo. During those same 48 hours, any attendee seated at your table can remove any of that table’s photos from your Outpost recap, without asking us. Removal is permanent: we delete the photo, and there is nothing left to restore. After the 48 hours have passed, those self-serve controls close and the photos become part of the record of the event; you can still ask us to take one down by emailing hello@outpost.rsvp, and we will honor those requests.

What removal cannot reach. Removal cannot reach a copy that has already been downloaded. The organization sponsoring your Outpost gains access to your table’s photos specifically so that it can download and use them, and once a copy exists outside Outpost — in an organization’s own files, on somebody’s device, or in material already published — deleting the photo from Outpost does not delete that copy. We will stop our own further use of a photo we take down, but we cannot retrieve copies that have already left our systems.

We retain the photos added at an Outpost indefinitely, as described in our Privacy Policy.

The Website and the Services, and their entire contents, features, and functionality, are owned by Outpost, its licensors, or other providers of such material and are protected by U.S. and international intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Services except as expressly permitted here or with our prior written consent.

“Outpost,” the Outpost logo, and other Outpost names, logos, and marks are trademarks of Folx Table LLC. You must not use them without our prior written permission.

You agree not to use the Services:

• In any way that violates any applicable law or regulation.
• To harass, threaten, or harm another attendee or any other person.
• To impersonate any person or misrepresent your identity, age, or affiliation.
• To transmit spam, chain letters, or unauthorized advertising.
• To attempt to gain unauthorized access to the Services, other users' accounts, or our systems.
• To use any robot, spider, or other automated means to access the Services without our prior written consent.
• To introduce viruses, malware, or other technologically harmful material.

The Services may contain links to third-party websites, including a Host Organization’s own site or social media pages. We are not responsible for the content, security, or practices of any third-party site.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY OUTPOST, MATCH, OR ATTENDEE WILL MEET YOUR EXPECTATIONS.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL OUTPOST, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, YOUR ATTENDANCE AT AN OUTPOST, OR YOUR INTERACTIONS WITH OTHER ATTENDEES OR ANY VENUE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO OUTPOST IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

You agree to defend, indemnify, and hold harmless Outpost, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your use of the Services, or your conduct at an Outpost.

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law principles. Subject to the Arbitration Agreement below, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Nashville, Davidson County, Tennessee, and you consent to jurisdiction and venue there.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution First. Before filing a claim against Outpost, you agree to first contact us at hello@outpost.rsvp and attempt to resolve the dispute informally for at least 60 days.

Binding Arbitration. If we can’t resolve the dispute informally, you and Outpost agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association under its consumer arbitration rules, rather than in court, except that either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect its intellectual property rights.

Class Action Waiver. You and Outpost agree that any arbitration or claim will be conducted only on an individual basis and not as a class, consolidated, or representative action. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) may proceed in court, but the rest of this arbitration agreement still applies.

Right to Opt Out. You may opt out of this arbitration agreement by emailing hello@outpost.rsvp within 30 days of first accepting these Terms, stating that you decline to be bound by it. If you opt out, disputes will instead be resolved in the courts identified in Section 16.

Jury Trial Waiver. You and Outpost waive any right to a jury trial for any dispute covered by this arbitration agreement.

ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CLAIM ACCRUES, OR IT WILL BE PERMANENTLY BARRED.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Outpost regarding the Services.
